The
same Federal/HIPAA and state laws that protect the medical
records apply to the EAP. The EAP may be used without jeopardizing
the employees present position or future job opportunities.
Absolutely none of the information is passed onto the company
or your personnel file. No information is exchanged in any
capacity without the expressed written consent of the client
by signing a confidential release allowing an exchange to
take place, except as required by Federal or Statues, i.e.,
Safety Sensitive Operations, Drugs in the workplace act, Federal
DOT Substance Abuse Evaluations, Homicide, Suicide, Child
Abuse or Elderly Abuse.
To
further protect all eligible EAP clients confidentiality,
no two clients from the same company are booked appointments
with the EAP counselor at the same time.
In
keeping with the federal and state laws of confidentiality,
family members over the age of 18 must call the EAP to make
his/her own appointment. |
